This timeshare year of 2024, the focus was on active duty military service members and veterans who work in military-related professions. We have heard from hundreds of active duty service members and veterans who found their security clearances in jeopardy because they financed a timeshare. We feel no one serving our country should lose their security clearnance because they financed a timeshare.

In addition to the Military Lending Act, there have been lawsuits filed accusing timeshare developers of not complying with the ServiceMembers Civil Relief Act (SCRA). Yorks and Fissix vs Travel & Leisure/Wyndham is one such lawsuit. Taya Fissix, active duty Army, is a SCRA subclass in this lawsuit. The Yorks settled with Wyndham.

We are grateful to Kimberly Calhoun, host of PBS Money Masters, who produces and co-hosts Timeshare Solution or Surrender. The show has brought people together in a way never before achieved. Several TARDA volunteers, including Kim, attended Delaware oral arguments in Kirchners vs Wyndham. While the courts ruled that plaintiffs could pursue their grievances in court, as opposed to arbitration, a motion to certify class was denied. Class actions alleging fraud are difficult because reports of damages or liabilities are not uniform. Illinois attorney Howard Prossnitz appeared on our PodTV show, Timeshare Solution or Surrender, April 15, Episode 15 to discuss this case and others.
